1. ELIGIBILITY: The Sweepstakes is only open to legal residents of the fifty (50) states of the United States, Washington, D.C. and Aruba who are guests at a participating Marriott Vacation Club, Sheraton Vacation Club or Westin Vacation Club resort (referred to together as the “Resorts” and singularly as a “Resort”) during the Sweepstakes Period who have reached the age of majority in their state of residence at the time of entry. This Sweepstakes is not open to the general public. Employees, officers, and directors of Sponsor, Don Jagoda Associates, Inc. ("Administrator"), any of their respective parent companies, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, website providers, web masters, prize suppliers, and members of their immediate families (spouses, parents, children, siblings, and their spouses, regardless of where they live), and those living in the same household are not eligible to enter or win. Winning a prize is contingent on fulfilling all requirements set forth herein. Sponsor and Administrator reserve the right to verify the eligibility of winners.
2. HOW TO ENTER: THE SWEEPSTAKES: Resort guests may enter the Sweepstakes during their stay at one of the Resorts within the Sweepstakes Period by completing and signing an entry card given out to guests who show their room key to a marketing associate at the Resort as follows: hand write your name, email address, full mailing address, primary phone number, household income and the date on a Sweepstakes entry form which can be obtained at one of the Resorts, and depositing the completed Sweepstakes entry form into the ballot box or provide it at the designated location.
Entries must be submitted by the end of the Sweepstakes Period to be eligible.
Limit: One (1) Instant Win Game play per villa, per family. All entries must be complete to be eligible to enter and win.
All potential winners are subject to verification before any prize will be awarded. If you are determined the Sweepstakes winner you will be sent an affidavit package or address verification letter within 6-8 weeks after verification. Potential winning message is subject to verification by independent judges whose decisions are final. Proof of play and/or winning will not be deemed to be proof of winning by Sponsor.
Sponsor and its agencies are not responsible for lost, late, incomplete, invalid, damaged, stolen, misdirected, unintelligible, or illegible entries, which will be disqualified. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor. Any attempt by any participant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses, or any other method will void that participant’s entries, and that participant may be disqualified at Sponsor’s discretion. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider, internet service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account-holder. Entries specifying an invalid, nonworking, or inactive email address will be disqualified and ineligible to win. All potential winners are subject to verification before any prize will be awarded. All entries must be complete to be eligible to enter and win. Normal internet access, phone, and usage charges imposed by your online or phone service provider may apply.
All entrants agree that Sponsor shall own the entries, which will not be acknowledged or returned, and that Sponsor will not verify receipt of entries. Sponsor and Sponsor’s agents, affiliates, service providers, or prize suppliers may use entrants’ personal information submitted with entry for purposes of Sweepstakes administration and prize fulfillment. Sponsor will not sell personal information submitted with entry to outside solicitors.
3. RANDOM DRAWING: One (1) winner (“Prize Winner”) will be selected from among all eligible entries received during the Sweepstakes Period. The random drawing will be held on or about January 10, 2025.
Drawings will be conducted by Administrator, an independent judging organization whose decisions are final on all matters relating to the drawing. Odds of winning are dependent upon the total number of eligible entries received.
Prize Winner will be notified by email. Except where legally prohibited, the potential Prize Winner will be required to sign and return, within ten (10) days of being notified, an Affidavit of Eligibility, Liability & Publicity Release in order to claim their prize. If a prize notification is returned as undeliverable, if a potential Prize Winner is disqualified, if a potential Prize Winner declines to accept the prize, if a potential Prize Winner fails to sign and return the Affidavit of Eligibility, Liability & Publicity Release within the required time period, or if a potential Prize Winner is unavailable to accept the prize within the time period specified by Sponsor for any reason, the potential Prize Winner will be disqualified and will forfeit his/her prize, and an alternate potential Prize Winner will be selected at random in his/her place from among all eligible entries received from the appropriate pool of entries within ten (10) business days of the date potential Prize Winner is determined to be ineligible. Alternate potential Prize Winner must satisfy all eligibility requirements. Ten (10) alternate Prize Winners will be selected for the prize offered, after which time the prize will remain un-awarded.
4. PRIZE: One (1) grand prize will be awarded, which consists of either (a) 6 days and 5 nights at Marriott’s Ko Olina Beach Club in a mountain view guestroom, or (b) 400,000 Marriott Bonvoy™ points (at the choice of the Prize Winner). The approximate retail value (“ARV”) of the (i) stay at Marriott’s Ko Olina Beach Club is $4,250, and (ii) the Marriott Bonvoy points is $5,000.
The odds of winning the grand prize depend on the number of eligible entries received during the Sweepstakes Period. Allow 4 – 6 weeks for fulfillment.
5. PRIZE RESTRICTIONS: Any and all applicable federal, state, local, and municipal taxes, and all fees and expenses (such as airfare, ground transportation, parking, security fees, gratuities, luggage fees, resort fees, meals, and incidental charges) related to acceptance and use of each prize not specifically stated herein are the sole responsibility of the winner. The winner will be issued an IRS 1099 form for the appropriate retail value of his/her prize. The actual value of the five (5) night stay at Marriott’s Ko Olina Beach Club is expected to vary based on fluctuations in resort pricing. If the actual value of the prize is less than stated, the difference will not be awarded in cash, and no such claim will be honored. Prizes are provided “as-is” and without any warranty of any kind. Prizes are not transferable. Prizes cannot be substituted or redeemed for cash; however, Sponsor, at its sole discretion, reserves the right to substitute prize for one of equal or greater value if the prize should become unavailable for any reason. Sponsor will not replace any lost or stolen prize. Prize cannot be used in conjunction with any other promotion or offer. Only the prizes stated in these Official Rules are available to be won in the Promotion. The Ko Olina prize stay must take place within one (1) year of the date the prize is awarded or the stay will be forfeited; reservations are based on availability. Please note that transportation is not included as part of the prize. Prize Winner is responsible for all travel costs. Reservations are based on availability; certain restrictions and blackout dates apply (reservations will not be available for dates that include a holiday or from March 2 – 31). Sponsor shall not be responsible for any cancellations, delays, diversions, or substitutions, or any act or omissions whatsoever by any air carrier(s) or other transportation companies, or any other persons providing any of these services to passengers, including any results thereof, such as changes in services or accommodations necessitated by same.
In the event the Prize Winner and/or his/her guest engage(s) in behavior during the stay, that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor may terminate the stay early and send the Prize Winner and/or his/her guest home with no further obligations or compensation whatsoever to the Prize Winner and/or his/her guest [which may, in Sponsor’s sole discretion, result in the Prize Winner’s disqualification from the Sweepstakes and forfeiture of any (and/or all) prize(s)]. 11. PRIVACY: Information collected from entrants is subject to the Sponsor’s Privacy Policy, which can be found at marriottvacationclub.com/privacy.html. Sponsor and Sponsor’s agents, affiliates, subsidiaries, representatives, prize suppliers, or service providers may use entrants’ personal information submitted with entry for purposes of Instant Win Game administration and prize fulfillment. Sponsor will not sell personal information submitted with entry to outside solicitors. Every time participants receive a marketing email or a direct mailer promoting a sweepstakes or contest, they will have the choice to opt-out of future marketing emails and sweepstakes/contest mailers, respectively, by following the instructions provided therein.
